How names are compared

Under Ark. Code § 4-27-401 (and the parallel LLC, LP, and nonprofit statutes), a name is considered “the same” as an existing filing when it matches after ignoring differences that don’t legally distinguish a name:

Case — upper/lower case is ignored.
Corporation type— e.g. “Acme LLC” vs “Acme Inc.”
Punctuation, spacing & initials— e.g. “Wal-Mart” vs “Walmart,” “J B C” vs “JBC.”
Common words(and, of, the, plus, to, &) — e.g. “Smith and Sons” vs “Smith Sons.”
Names that sound alike— e.g. “Wright” vs “Right.”
